Terms, Conditions and Refund Policy

These Terms, Conditions and Refund Policy apply to purchases made through laurieschamber.com (the “Website”).

The Website and products offered through it are operated and sold by:

By placing an order through the Website, you confirm that you have reviewed and accepted these terms.

1. Products

The Website sells books and related products written or published independently by Laurie Schamber.

Unless a product page expressly states otherwise, an eBook purchase is for a digital EPUB file. No physical product will be shipped when purchasing an item identified as an eBook or digital product.

Product descriptions, prices, formats, compatibility information, download restrictions and other information displayed on the applicable product page form part of your purchase agreement.

2. Independent Publication

Lindsay Clancy: Evidence and Public Opinion — The Trial the Internet Decided is an independently written and published work.

The book and Website are not sponsored, authorized or endorsed by Lindsay Clancy, her family, any lawyer, law firm, court, government agency, media organization, social-media platform, Amazon or any other person or organization discussed in the book.

3. Prices, Currency and Taxes

Prices are displayed in the currency identified on the product page or during checkout.

Applicable sales taxes, including Canadian GST or other taxes where required, will be calculated and displayed during checkout before the order is submitted.

The complete price, including applicable taxes, will be shown before payment is authorized.

4. Orders and Payment

Payment is processed through the payment methods made available during checkout.

Your order is accepted when payment has been successfully processed and an order-confirmation page is displayed or an order-confirmation email is issued.

An order may be cancelled or refunded if:

  • Payment cannot be authorized;
  • The product is unavailable;
  • A technical or pricing error affected the transaction;
  • The transaction appears unauthorized or fraudulent; or
  • Cancellation is otherwise required by law.

Payment-card information is handled by the applicable payment processor. Laurie Schamber does not directly receive or store your complete payment-card number.

5. Customer Accounts

A customer account may be created during checkout to provide secure access to digital purchases.

You are responsible for:

  • Providing accurate account and order information;
  • Maintaining the confidentiality of your password;
  • Using the account only for your own purchases; and
  • Promptly reporting suspected unauthorized access.

You must not share account credentials or use another purchaser’s account to access a digital product.

6. Digital Delivery

Digital purchases are normally available immediately from the order-confirmation page and through My Account → Downloads.

Account, order-confirmation or password-setup emails may take up to 15 minutes to arrive. Email delivery can also be affected by spam filtering, the purchaser’s email provider or other systems outside the Website’s control.

If you cannot access a purchase, contact laurieschamber@gmail.com and provide:

  • Your order number;
  • The purchaser’s name;
  • The email address used during checkout; and
  • A description of the problem.

7. Download Limits and Expiry

Unless the product page states otherwise, each purchased eBook may be downloaded a maximum of three times within 30 days after purchase.

A download may be counted when the server successfully begins delivering the file, even if the purchaser later interrupts the download.

Purchasers should download the file promptly and keep a lawful personal backup. Expired links or exhausted download limits may be restored at Laurie Schamber’s discretion when a legitimate technical problem prevented access.

Refunded, cancelled, reversed or fraudulently obtained orders may have their download access revoked.

8. Personal Digital Licence

An eBook purchase gives the purchaser a limited, personal, non-exclusive, non-transferable licence to read and store the purchased file for personal use.

Ownership of the copyright and intellectual property does not transfer to the purchaser.

You may place your purchased copy on devices and reading applications that you personally use. You may also use a legitimate personal conversion or delivery service, such as Amazon’s Send to Kindle service, solely to read your own purchased copy.

You may not:

  • Share, sell, lend, rent, sublicense or distribute the file;
  • Upload it to a public or shared website, server, drive, forum or file-sharing service;
  • Email or transmit copies to other people;
  • Remove or alter licence, copyright, metadata or watermark information;
  • Attempt to conceal the source of a distributed copy; or
  • Use the file for commercial redistribution or machine-learning training without written permission.

Rights provided by applicable copyright law are not restricted by this section.

9. Purchaser-Specific Watermarking

Each delivered EPUB may be personalized locally by the Website.

The personalized copy may include:

  • The purchaser’s name;
  • A masked version of the purchaser’s email address;
  • The WooCommerce order number;
  • A unique traceable identifier;
  • A personal digital-licence page; and
  • Embedded identifiers within the EPUB’s metadata and internal files.

This information is used to identify the licensed purchaser, administer download access, discourage unauthorized distribution and investigate suspected sharing or infringement.

The watermark does not monitor reading activity, access a purchaser’s device or report how the book is read.

By purchasing and requesting delivery of the eBook, you acknowledge and consent to this purchaser-specific personalization.

10. Device and Software Compatibility

The EPUB format is compatible with Apple Books, Kobo and many EPUB-reading applications. Kindle users may upload the EPUB through Amazon’s Send to Kindle service.

The purchaser is responsible for confirming that their device or reading software supports EPUB files or an appropriate conversion or delivery method.

Compatibility with every device, application, operating system or third-party service cannot be guaranteed. Third-party services may change their technical requirements without notice.

Assistance will be provided where reasonably possible if a valid EPUB file cannot be opened using ordinarily compatible software.

11. Refund and Replacement Policy

Because an eBook is supplied immediately and cannot practically be returned after access has been provided, digital purchases are generally final once the download has been made available.

A refund, replacement file or renewed download access may be provided when:

  • The purchased file was not delivered;
  • The download link did not function;
  • The file is corrupt or materially defective;
  • The purchaser received the wrong product;
  • The purchaser was accidentally charged more than once for the same product;
  • The product supplied is materially different from its description; or
  • A refund or cancellation is required by applicable law.

A refund will not ordinarily be provided because:

  • The purchaser changed their mind;
  • The purchaser did not like or agree with the book;
  • The purchaser failed to review the product description or content notice;
  • The purchaser’s device or chosen application does not support EPUB files;
  • The purchaser allowed the 30-day access period to expire;
  • The three-download limit was exhausted without a reported technical problem;
  • The purchaser lost or deleted the file after successfully downloading it;
  • A third-party reading, conversion or delivery service is unavailable; or
  • Access was revoked because of a refunded, cancelled, reversed or unauthorized transaction.

To request assistance or a refund, email laurieschamber@gmail.com with the order number, purchaser’s email address and an explanation of the problem.

Approved refunds will be returned through the original payment method. Processing time after approval depends on the payment processor and financial institution.

Nothing in this policy limits a cancellation, refund or other remedy that cannot legally be excluded or waived.

12. Chargebacks and Payment Disputes

If there is a delivery, duplicate-payment or product problem, please contact laurieschamber@gmail.com so the issue can be investigated.

This request does not limit any right to contact your payment provider or exercise a legal remedy.

13. Copyright and Website Content

Unless otherwise stated, the books, written content, graphics, page designs, downloadable files and other original materials offered through the Website are owned or licensed by Laurie Schamber and are protected by applicable copyright and intellectual-property laws.

You may not reproduce, distribute, republish or commercially exploit Website content without permission, except as permitted by law.

14. Content Notice

Products concerning criminal proceedings may contain detailed discussion of homicide, child death, mental illness, suicide, medication, medical evidence and other distressing subjects.

Customers are responsible for reviewing the product description and content notice before purchasing. These products are intended for mature readers.

15. Informational Purpose

Books and Website content reflect the author’s research, analysis and commentary. They are provided for informational and literary purposes.

Nothing on the Website or in a purchased product creates a lawyer-client relationship or constitutes individualized legal, medical, psychiatric or other professional advice.

Although reasonable efforts are made to present information accurately, interpretations and conclusions may be disputed, and legal proceedings or publicly available information may change after publication.

16. Website Availability

Reasonable efforts are made to keep the Website, customer accounts and downloads available. Continuous or error-free operation cannot be guaranteed.

Temporary interruptions may occur because of maintenance, hosting problems, payment processing, security measures, software updates or circumstances outside reasonable control.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Laurie Schamber will not be liable for indirect, incidental, special or consequential losses resulting from the use or inability to use the Website or a digital product.

For a claim relating directly to a purchase, total liability will not exceed the amount paid for the affected product, except where a different remedy is required by law.

Nothing in these terms excludes liability or consumer rights that cannot legally be excluded.

18. Privacy

Personal information is handled in accordance with the Website’s Privacy Policy. The Privacy Policy explains what information is collected, how it is used and how purchaser-specific EPUB watermarking operates.

19. Changes to These Terms

These terms may be updated when products, Website functions, service providers or legal requirements change.

The terms presented and accepted when an order is placed will apply to that order unless a later change is required by law or is more favourable to the purchaser.

20. Governing Law

These terms are governed by the laws of British Columbia and the applicable laws of Canada.

Consumers may also have mandatory rights under the laws of the jurisdiction in which they reside. Nothing in these terms requires a consumer to waive a protection or remedy that cannot legally be waived.

21. Severability

If any provision of these terms is found unenforceable, that provision will be interpreted or limited only to the extent necessary, and the remaining provisions will continue to apply.
